Terms of Use

1. Scope and provider

These terms apply to the use of the Qi Rise app and the related website. The provider is Daniel Rehberg, c/o MDC#2117, Welserstraße 3, 87463 Dietmannsried, email hello@qirise.app ("we"). See the Imprint for further details. How we handle data is described in the Privacy Policy.

By creating an account or using the app you accept these terms. Different terms do not apply.

2. Health notice

Qi Rise does not replace medical advice, diagnosis or treatment and is not a medical device. Training plans, camera feedback, heart rate and calorie figures are for motivation and orientation only and may be inaccurate.

• Talk to a doctor before training if you have pre-existing conditions (e.g. cardiovascular, joints, back), are pregnant, take medication, have not exercised for a long time or are unsure.
• Warm up before every session. Stop immediately if you feel pain, dizziness, shortness of breath, tightness in the chest or unwell, and seek medical help if needed.
• Train on a clear, non-slip surface with enough room. Place your phone securely and watch out for people, animals and objects nearby.
• Martial arts techniques are meant for solo practice only. Do not use them against others.
• Minors should train with their parents' knowledge.

You train at your own responsibility and adapt pace, volume and exercises to your condition.

3. Services

Qi Rise offers daily kung fu fitness training with a teacher character, optional posture recognition via camera, progress with XP, ranks and streaks, story chapters, avatars and outfits, and social features (friends, league, dojos, chat, challenges).

• Free: basic path, daily training, streak, league, social features, one master training per week, counting mode of the camera.
• "Meisterweg" subscription: additional content and features as described in the app before purchase (e.g. unlimited master trainings, full story, learning mode with feedback, monthly jade and exclusive items).
• One-time purchases: e.g. additional paths or jade packs.

Some features require an account, an internet connection, a camera or an Apple Watch. We do not sell random rewards for money.

4. Account and age

• You must be at least 16 years old. Before your account is created, the app asks for your year of birth; your answer must be true. We count from the year in which you turn 16. We may suspend and delete accounts of people under 16.
• If you are not yet of legal age, you need the consent of your parents or legal guardians for purchases.
• You sign in with your Apple ID and are responsible for the security of your device and Apple ID. One account per person is allowed; accounts are not transferable.
• Your username must not infringe third-party rights, be offensive, mislead about your identity or contain contact details or advertising. We may change inappropriate names.

5. "Meisterweg" subscription and purchases

• Purchase through Apple: All purchases in the app are made through Apple's App Store. Apple's terms (Media Services) also apply. Apple processes payment and is responsible for invoices, refunds and the statutory right of withdrawal for these purchases. Request refunds at reportaproblem.apple.com.
• Prices: The prices shown in the app before purchase apply, including VAT.
• Free trial: The subscription may include a 7-day free trial, once per Apple ID. If you do not cancel at least 24 hours before it ends, it automatically becomes a paid subscription.
• Renewal: The subscription runs for one month or one year and renews automatically for the same period unless you cancel at least 24 hours before it ends. Your Apple ID is charged within 24 hours before the end of the period.
• Cancelling: at any time in your iPhone settings under your name → Subscriptions. Cancellation takes effect at the end of the current period; until then the subscription remains usable. Deleting the app or your account does not cancel the subscription.
• Other offers: depending on availability, Meisterweg is also offered as a one-time purchase without a term, as a Duo subscription for two accounts or as a gift for a friend. The app shows you the scope, duration and price before you buy.
• Price changes for subscriptions are announced to you by Apple in advance; your consent may be required.

6. Coins, jade and items

Coins, jade, outfits and other items are virtual in-game content. You receive a simple, non-transferable right to use them in the app, but no ownership. They have no monetary value and cannot be exchanged for money, sold or transferred between accounts. Purchased jade and items remain available as long as your account exists and the app is offered. Status such as rank and league cannot be bought. We may adjust game balance (e.g. in-game prices, rewards) without devaluing content you have already bought.

7. Community rules

Qi Rise thrives on cheering each other on. In chat, usernames, dojo names and everywhere else:

• Respect: no insults, harassment, threats or bullying.
• No hate: no discrimination based on origin, skin colour, religion, gender, sexual orientation, disability or age.
• No prohibited or unsuitable content: no sexual, violent or extremist content, nothing that endangers minors, no calls for self-harm or dangerous training.
• Privacy: do not share personal data of yourself or others (address, phone number, photos, social media accounts) and do not ask to meet strangers.
• No spam and no advertising, no links to harmful sites, no selling of accounts or in-game content.
• Honesty: do not impersonate other people or the Qi Rise team.
• Obey the law and do not infringe others' rights (e.g. copyright and personality rights).

Report and block: you can report messages by long-pressing them and block people. We review reports promptly. You can also reach us at hello@qirise.app. If someone's life or health is in danger, please call the police (110) or emergency services (112) immediately.

Consequences: for violations we may remove content, restrict chat use, remove you from a dojo or suspend your account temporarily or permanently. We take into account the severity and whether it is a first offence, and inform you of the decision and the reasons where possible and permitted. You can object at hello@qirise.app. We may report unlawful content to the authorities.

8. Your content

You remain the owner of your messages, usernames and dojo names. You grant us the simple, free right to store and display them within Qi Rise and process them for moderation, as long as this is necessary for operation. You are responsible for your content and ensure you are allowed to share it.

9. Fair play

League, challenges and dojo goals should be fair. In particular, the following is not allowed: false training data, deceiving camera or heart-rate detection, multiple accounts for your own advantage, manipulating the app or servers, automated access and exploiting bugs. The server checks trainings for plausibility. For violations we may reset XP, rewards and rankings and apply section 7 (consequences).

10. Rights in the app

The app, its characters, images, videos, texts, story and marks are protected by copyright and trademark law. You receive a simple, non-transferable right to use the app for private purposes for the duration of use. Copying, redistribution, reverse engineering (unless permitted by law) or commercial use is not permitted. You may share share-cards from the app privately on social networks.

11. Availability and changes

We strive for good availability but cannot promise uninterrupted service, for example during maintenance, outages or failures of service providers. Training also works offline and is transferred later. We keep developing Qi Rise and may change features where this is reasonable for you and paid services remain essentially intact; we provide updates for digital products to the extent required by law (sections 327 et seq. German Civil Code).

12. Liability

• We are fully liable for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee.
• For slightly negligent breach of an essential contractual obligation (one whose fulfilment makes proper performance of the contract possible in the first place and on which you may rely), liability is limited to the typical, foreseeable damage.
• Otherwise, liability for slight negligence is excluded.
• Statutory warranty rights for digital products remain unaffected.

13. Term, termination, suspension

The usage contract runs for an indefinite period. You can end it at any time by deleting your account in the app (Settings → Your data → Delete account). An active subscription must be cancelled separately with Apple (section 5). On deletion, progress, coins, jade and items are lost.

We may terminate the contract with 4 weeks' notice; already paid subscription periods remain usable or are refunded pro rata. The right to extraordinary termination and suspension for good cause, in particular for serious or repeated violations of section 7 or 9, remains unaffected.

14. Notes on Apple

These terms exist only between you and us, not with Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support. If the app fails to meet a warranty, you may notify Apple, which may refund the purchase price. Apple has no further warranty obligations. We, not Apple, are responsible for claims relating to the app (e.g. product liability, consumer protection, third-party rights). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. In addition, Apple's standard licensed application end user licence agreement applies unless these terms provide otherwise.

15. Final provisions

• Changes to these terms: we may amend these terms for a valid reason (e.g. new features, changed legal situation). We will inform you in the app at least 4 weeks in advance. Changes that only concern new features or are purely editorial apply from the announced date. All other changes, in particular to services, prices or your rights, only apply once you expressly accept them in the app. If you do not accept, the previous terms continue to apply; either party may then terminate the contract.
• Law: German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected.
• Dispute resolution: we are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
• Severability: if a provision is invalid, the rest remains valid; statutory provisions then apply.
• Language: the German version prevails. The English version is for information.
